Terms and Conditions
These Terms and Conditions constitute the agreement between passengers and SmartSailing.
Throughout these Booking Terms and Conditions, "you" denotes all passengers under the same booking reference number, and "we" refers to the Tour operator, namely SmartSailing representing the brand name SmartSailing.
These Terms and Conditions, along with the information available on our website www.smartsailing.co.uk, cover the relationship, responsibilities, and liabilities between all persons named on the tour operator's booking forms, irrespective of whether you have reviewed them. Therefore, we strongly advise careful consideration of these terms upon making a booking, as they serve to protect the rights of both parties.
Booking Your Trip and Confirmation by The Tour Operator
1 . A booking is confirmed by the tour operator upon receipt of a deposit or full payment.
2. Completion of the booking form on our website is required to confirm a booking, to be undertaken by the individual booking or the lead passenger, who must be at least 18 years old. For passengers under 18, the tour operator's authorization is necessary.
3. Upon receiving all required forms and subject to availability, the tour operator reserves your place(s) and issues an initial invoice for the deposit or full payment, with a specified due date. It remains the passenger(s)' responsibility to ensure the accuracy of the booking and trip information.
4. After receiving all payments (see clause 5), subject to availability, we finalize the booking by issuing a confirmation invoice. Any discrepancies should be reported immediately upon receipt. Failure to notify us within 10 days of receiving the confirmation may impact our ability to make corrections, possibly incurring administrative costs.
Deposits and Payments
5. To confirm your sailing trip, a deposit of 100 EUR per passenger (or full payment if within 60 days of the trip) is required at the time of reservation.
6. The balance must be received not less than 60 days before the trip start date, as indicated on the confirmation invoice.
7. Non-payment may result in the assumption of a cancellation request, permitting us to retain your deposits.
Changes and Cancellation by you
8. Written notification is required for any requested changes to your confirmed trip. While we'll attempt to accommodate such requests, an amendment fee of 20 EUR per booked passenger may apply, alongside other incurred costs.
9. Cancellation, to be considered valid, must be made in writing (email accepted) by the passenger(s). Charges upon cancellation are as follows:
- Over 60 days: Deposit (100 EUR)
- 59-45 days: 30%
- 45-31 days: 50%
- 30-15 days: 70%
- 14-0 days: 100%
10. Partially completed trips entail no refunds for unused services. Passengers can claim cancellation charges through their travel insurance, contacting their insurer directly.
Changes and cancellation by us
11. We endeavor to run all trips as advertised but reserve the right to make changes or cancellations, notifying passengers promptly.
12. Due to sailing conditions, deviations from itineraries may occur for safety reasons, with captain's authorization to make necessary changes.
13. Major changes may prompt alternative tour options or a full refund, allowing passengers choice.
Force Majeure
14. We hold responsibility unless circumstances amount to Force Majeure or result from passengers' actions or third-party involvement.
Insurance
15. While boat insurance is our responsibility, passengers must have adequate personal travel insurance covering various aspects, as outlined. Passengers are accountable for arranging their insurance.
Our Liability to You
16. Our tours involve inherent risks, and passengers participate willingly, acknowledging these risks.
17. Optional activities not operated by us are solely the passenger's responsibility, with us indemnified against related claims.
Behavior and Consideration of Others
18. We reserve the right to terminate holiday arrangements of passengers whose behavior poses a risk or annoyance to others, with decisions made onboard at the Captain's discretion.
Complaints
19. Immediate reporting of dissatisfaction allows us to rectify issues, with formal complaints to be made within 14 days after trip completion.
Special requests and medical issues
20. Passengers must inform the tour operator of any medical conditions or dietary requirements before confirmation. Compliance with health and travel documents is the passenger's responsibility.
Excursions and Optional Activities
21. Passengers partaking in optional activities accept responsibility, acknowledging potential risks. Our liability doesn't extend to operators of such activities.
Travel Documents
22. Passengers are responsible for complying with passport, visa, health, and immigration requirements. Failure to meet these requirements absolves us of any liability.
Privacy Policy
23. We collect personal details to process bookings, safeguarding this information and not sharing it with third parties. Passengers may receive promotional communications, with the option to unsubscribe.
Contract
24. This contract becomes effective upon reservation, governed by English Law, with both parties consenting to the jurisdiction of British Courts.
